Version: 4.1

1.0 Terminology

The following terminology applies to these skydive Terms and Conditions:

Customer,” “you,” and “your” mean the person accessing this website, making a reservation, purchasing a product or service, or participating in services.

“Company,” “we,” “us,” “our,” “Current Operator,” and “Skydive Monterey Bay” mean Uninsured Skydive Monterey Bay Inc., a California corporation doing business as Skydive Monterey Bay.

“Website” means skydivemontereybay.com.

“Reservation” means a booking made with and accepted by the Current Operator

1.1 Scope of These Terms

These Terms govern transactions with the Current Operator, including reservations, deposits, payments, gift cards, flight vouchers, and account credits sold, received, accepted, or issued by the Current Operator.

The Skydive Monterey Bay trade name has been used by more than one legal operator. The appearance of the Skydive Monterey Bay name on an older certificate, voucher, deposit, reservation, or account record does not, by itself, identify the legal entity that issued it. Nothing in these Terms, by itself, constitutes the acceptance, reissuance, or assumption by the Current Operator of an obligation originally issued by another legal entity.

2.0 Conditions of Use

SKYDIVE MONTEREY BAY provides its services to you subject to the following conditions. If you visit or use this website, you accept these conditions. Please read them carefully.

3.0 Privacy

We are committed to protecting your privacy. Our collection, use, and disclosure of your personal information, which may include your phone number, email address, name, and credit card number will not be shared, sold, or disclosed to any third-party.

4.0 Skydiving Participation Conditions

Completing a reservation on this site does not provide you with express consent or the right to partake in skydive activities at SKYDIVE MONTEREY BAY.

You must be at least 18 years of age.

You must bring valid government-issued photo identification to SKYDIVE MONTEREY BAY to verify your age and identity.

In order to participate in skydiving activities, you must be in reasonably good physical condition. Weight restrictions begin at 200 LBS. If you weigh more than 200 LBS,  please contact us for more information. Notwithstanding these physical conditions and weight limitations, all customers may be evaluated by a SKYDIVE MONTEREY BAY instructor for height weight proportion and may be refused for safety reasons depending on the outcome of the evaluation.

You must disclose all previous and current injuries, medical conditions, and medications (including over the counter drugs) prescribed and taken. If your doctor has specifically restricted or recommended that you do not participate in adventure activities, you must disclose that to SKYDIVE MONTEREY BAY.

You must not consume any alcohol or drugs within a minimum of twelve hours prior to your skydive. SKYDIVE MONTEREY BAY operates a strict zero alcohol and drug tolerance policy. If at any time we conclude that you or any of your jumping participants are under the influence of any substance, alcohol, or drug-related, you will not be permitted to fly and will be escorted off of our facilities.

Notwithstanding the above, even if all above conditions are met, SKYDIVE MONTEREY BAY reserves the right to refuse service to any unruly or difficult customers for any reason in respect to general safety concerns.

5.0 Reservation Policy

A $50 per person, non-refundable, the deposit is required to make a reservation.

Reservations are recommended, however, they are not required. If you decide to not make a reservation, then you will be considered as a “walk-in”. If you do not make a reservation, you do not have access to the Reservation Rate or any additional discounts.

Your reservation time is your arrival time; not your jump time. SKYDIVE MONTEREY BAY recommends that you plan an additional 20-30 minutes travel time in anticipation of any unforeseen traffic delays while en route.

If you are late for the scheduled arrival time, we cannot guarantee that you will be able to jump that day. Meaning, you may miss your class and/or your flight and could forfeit your deposit.

Absolutely no metal or non-essential items can be brought into the airplane, either hidden or exposed. This includes, but is not limited to, keys, watch, wallet, mobile phones, cameras, jewelry, or any item that is droppable, breakable or could be considered a snag hazard.

If a weather or technical issue prevents you from jumping on your reservation day, we will reschedule you for a different day so your deposit will stay “on-account”. SKYDIVE MONTEREY BAY will attempt to reschedule at your convenience, but we do not provide refunds.

SKYDIVE MONTEREY BAY reserves the right to refuse service to any unruly or difficult customers for any reason with no refunds.

6.0 Online Registration and Payment Processing

If you make a reservation using this site, you will be required to pay a non-refundable deposit of $50 per person. As such, you will be required to provide personal and financial details. Our site provides SSL for online payment processing.

7.0 Payment

SKYDIVE MONTEREY BAY accepts cash, Visa, and MasterCard. A $50 per person, non-refundable, deposit is required to secure a reservation. Full payment and a waiver must be properly accepted before anyone will be allowed to participate in any skydiving activity.

Deposits and/or any payment made will be credited to your account. Any deposit or payment paid will be deducted from the total balance owing. Payment on this site is made via a secure third-party payment processor that handles all aspects of the payment process. Any payment specific issues or disputes should be resolved directly with the payment processor.

8.0 Pricing

All prices listed on this site are in United States cash currency (USD) unless otherwise noted, and are subject to change by SKYDIVE MONTEREY BAY without any notice to you. All services assume the remaining balance be paid in cash currency and reflect a cash discount. All services are subject to a 6% airport facilities fee. Applicable taxes, shipping, and handling charges will be added, if and when applicable. SKYDIVE MONTEREY BAY may change pricing options as well as change any promotional offer(s) at any time without prior notice. Promotions are in effect only for the time periods as specified on the site.

9.0 Refunds, Credits, and Flight Vouchers

Except where required by law, deposits and sales made with the Current Operator are non-refundable.

When the Current Operator is unable to complete a scheduled jump because of weather, aircraft availability, safety conditions, or another operational reason, an eligible amount actually paid to the Current Operator may remain as a Current Operator account credit or be documented by a Current Operator flight voucher.

Current Operator credits and flight vouchers do not expire under our current policy and may be transferred. They are non-combinable and remain subject to verification, current pricing, participation requirements, availability, and the Current Operator’s late-change and no-show policies.

This policy applies only to eligible amounts received by the Current Operator. Older instruments bearing the Skydive Monterey Bay name are subject to the issuer-verification process described in these Terms.

All deposits and sales are non-refundable. Payments and/or credits do not expire and may be transferred to other parties. A change to your reservation less than 48 hours prior, may result in additional charges or loss of deposit or payment, whichever is applicable.

10.0 Cancellation Policy

Minimum 48 hours notice, prior to the booking time, is required to make a change to your reservation to avoid forfeiting your deposit.

11.0 Product Descriptions

SKYDIVE MONTEREY BAY and its associates attempt to be as accurate as possible. However, SKYDIVE MONTEREY BAY does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free.

12.0 Gift Cards and Gift Certificates

The Current Operator accepts eligible gift cards and gift certificates sold or issued by Uninsured Skydive Monterey Bay Inc. d/b/a Skydive Monterey Bay that can be verified in the Current Operator’s transaction records.

Gift cards sold and issued by the Current Operator do not expire, may be transferred, and are non-refundable except where cash redemption or another remedy is required by California law. Any promotional component is subject to the written promotional terms disclosed at purchase and applicable law.

Older gift cards or gift certificates bearing the Skydive Monterey Bay name may have been issued by a prior legal operator. These instruments must be reviewed under the “Older Certificates, Vouchers, Credits, and Deposits” section before a reservation is made.

A credit card may be required to secure a reservation made with a gift card. The card will be charged only as described in the Current Operator’s reservation, late-change, and no-show policies.

12.1 Older Certificates, Vouchers, Credits, and Deposits

An older gift certificate, gift card, rain check, flight voucher, reservation deposit, or account credit bearing the Skydive Monterey Bay name must be reviewed to identify its issuing legal entity, original transaction, amount paid, prior-use status, and applicable terms.

Instruments sold or issued by Uninsured Skydive Monterey Bay Inc. d/b/a Skydive Monterey Bay are governed by these Terms. An instrument issued by a prior, separate legal entity is not automatically a balance of the Current Operator.

To request a review, please provide a copy or photograph of the instrument, the original purchaser’s name and email address, the issue date, the scheduled-jump date if applicable, and the certificate, reservation, or transaction number.

Submission or review does not establish acceptance, validity, liability, reissuance, or assumption by the Current Operator. After reviewing the available records, the Current Operator will explain whether the instrument is governed by these Terms and whether any separate voluntary promotional or courtesy accommodation is available.
